Medical Malpractice

Medical Malpractice occurs when a physician, nurse, medical assistant, hospital or other medical practitioner acts in a negligent manner when treating a patient.  Medical malpractice can occur from an action taken by the health care provider or by the failure of a health care provider to take medically necessary action.  Medical malpractice can be caused by surgical errors or mistakes, operations on the wrong part of the body, leaving instruments and sponges in the patient after the surgery, childbirth, laparoscopy surgery, cosmetic surgery and the administration of medications.  Attorney Bryan W. Smith has represented patients in medical malpractice cases for over 18 years.

Medical malpractice is a leading cause of wrongful death in the United States.  Wrongful death is defined as the death of an individual as a direct result of the negligence of another individual or company.  Wrongful death claims are usually pursued by a spouse, spouse’s children and other relatives of the individual killed by the negligence. It is estimated that over 200,000 people die from medical malpractice related injuries every year.  The Institute of Medicine of the National Academies have estimated over one and a half million Americans were potentially harmed or killed by medication errors and medical negligence in the year 2006 alone.

Selecting an attorney to handle a medical malpractice or wrongful death case is a very important decision.  Bryan has handled medical negligence cases for 17 years in both Kansas and Missouri.  A list of some of the settlements and verdicts obtained by Bryan during his career are listed under the settlements and verdicts section of this site.  If you would like to discuss any questions you may have regarding medical care you received or received by a loved one, please call Bryan Smith for a free consultation at 785-234-2453.
